JUSTICE SUNITHA GANDHAM CRIMINAL PETITION NO: 6840 OF 2026 ORDER: This petition is filed to quash the proceedings in Crime No.6 of 2026 dated 04.01.2026 on the file of Edlapadu Police Station, Palnadu District. 2. Heard the learned counsel for the petitioners, learned counsel for respondent No.2 and learned Assistant Public Prosecutor. 3. As seen from the record, severe allegations are leveled against the petitioners in the report given by the respondent No.2 and the said report is registered as a case in Crime No.6 of 2026 of the offence under Sections 75(2), 77, 127(2), 79, 308(2), 351(2), 324(2) r/w 3(5) of BNS Act. All the offences alleged against the petitioners are within seven years of imprisonment. 4. Learned counsel for the respondent No.2 and learned Assistant Public Prosecutor submitted that very grave allegations are leveled against the petitioners. 5. Learned counsel for the petitioners submitted that this is the 4th report given by the respondent No.2 and she has been keep on giving reports and the said reports have been registered against the petitioners. 6. This is not the proper time to go through the merits of the case. Learned counsel for the petitioners, learned counsel for respondent No.2 and learned Assistant Public Prosecutor, fairly submitted that this petition may be disposed of by giving direction to the Station House Officer, Edlapadu Police Station, Palnadu District, to follow the procedure under BNS coupled with the guidelines issued by the Hon’ble Apex Court in Arnesh Kumar vs. State of 4 Bihar & Another1 as the punishment for the alleged offences is within seven years. Basing on the material collected during investigation, the investigating officer can proceed in accordance with law. 7. In the result, this Criminal Petition is disposed of with a direction to the Station House Officer, Edlapadu Police Station, Palnadu District to follow the procedure under BNS coupled with the guidelines issued by the Hon’ble Apex Court in Arnesh Kumar (supra).
