For Respondent(s): Mr.K.Surendran, Additional Government Pleader (For R1) O R D E R This Writ Petition has been filed seeking for a limited relief. The petitioner seeks for early disposal of the petitioner’s application dated 13.12.2024 filed with the 1st respondent under the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, seeking for cancellation of the settlement deed dated 10.05.2017 bearing Document No.4458/2017, SRO, Periyannaikenpalayam, Coimbatore. The petitioner also seeks for a direction from this Court to permit the petitioner to be represented by an authorized representative or through Video Conferencing. 2.Mr.K.Surendran, learned Additional Government Pleader, accepts notice on behalf of the 1st respondent. The 2nd respondent is the son of the petitioner, against whom the petitioner has filed the application under Senior Citizen Act, 2007. __________ Page2 of 5 https://www.mhc.tn.gov.in/judis WP No. 11173 of 2026 3.No prejudice would be caused to the respondents if a direction is issued to the 1st respondent to dispose of the petitioner’s application filed under Section 23 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, on merits and in accordance with law, after hearing the objections of the 2nd respondent and by adhering to the Principles of natural justice, within a time frame to be fixed by this Court. Also no prejudice will be caused to the respondents if the petitioner who is aged 89 years is allowed to be represented by her authorised representative i.e., through a Power of Attorney, executed by the petitioner in favour of the said authorised representative in the proceedings to be conducted by the 1st respondent. Since no adverse orders are passed as against the 2nd respondent in this Writ Petition, notice to the 2nd respondent is dispensed with by this Court. 4.For the foregoing reasons, this Writ Petition is disposed of by directing the 1st respondent to pass final orders on merits and in accordance with law on the petitioner’s application dated 13.12.2024 filed under Section 23 of the Senior Citizens Act, seeking for cancellation of the settlement deed dated 10.05.2017 registered as Document No.4458/2017, SRO, Periyannaikenpalayam, Coimbatore, after hearing the objections of the 2nd respondent and by conducting a proper enquiry and by adhering to the Principles of natural justice, within a period of twelve weeks from the date of __________ Page3 of 5 https://www.mhc.tn.gov.in/judis WP No. 11173 of 2026 receipt of a copy of this order. The petitioner is also permitted to be represented by her authorised representative i.e., through a Power of Attorney executed in favour of her authorised representative, in the enquiry proceedings conducted by the 1st respondent.
