Mr. Nikhil Singhal, Advocate for the petitioners. 2. Petitioner filed a Suit for permanent prohibitory injunction along with temporary injunction application. 3. Learned Trial Court granted temporary injunction in favour of petitioners on 16.05.2023, restraining the defendant from creating any third-party interest over the suit property; however, in Appeal filed by the defendant, the order passed by trial Court was set aside. 4. Thus feeling aggrieved, petitioner has approached this Court challenging appellate Court’s order. 5. Since the interest of the petitioner is protected by doctrine of lis pendens, which is incorporated in Section 52 of Transfer of UKHC010104352026 2026:UHC:5011 Property Act, this Court do not find any reason to interfere with the appellate Court’s order. 6.
