JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner - accused is before this Court calling in question registration of a crime in Crime No.474/2025, pending before the XXIV Additional Chief Judicial Magistrate, Bengaluru, for the offences punishable under Sections 318(4), 64 and 352 of the BNS, 2023. 2. Heard Sri Harish Shiralakoppa, learned counsel for petitioner, Sri Channappa Erappa, learned High Court Government Pleader for respondent No.1 and Sri Sumanth S. Gowda, learned counsel for respondent No.2. - 3 - HC-KAR NC: 2026:KHC:19619 CRL.P No. 5352 of 2026 3. The petitioner is the accused, respondent No.2, the complainant. The two have had a physical relationship on the pretext of promise of marriage. The dispute between the two has now ended in a truce with them wanting to get married. 4. Learned counsel for the petitioner and respondent No.2 in unison submit that the engagement has already done and the date of marriage is fixed 23.05.2026. Therefore, the parties are before this Court filing an application under Section 359(1) r/w. 528 of the BNSS along with an affidavit of the complainant and joint memo of the parties before this Court, seeking permission to compound the offences. 5. In the light of the said circumstance, I deem it appropriate to record the terms of settlement that the parties have arrived at, with a rider that in the event, the marriage would not take place on the date indicated in the joint memo, these proceedings would stand automatically revived. The joint memo reads as follows: “1. The respondent No.1 police have filed FIR against the petitioner pending in the file in Crime No. 0474/2025 for the offence punishable under section 318(4), 64, 352 of BNS, on the file of XXIV Addl Chief Judicial Magistrate Court Bengaluru City. - 4 - HC-KAR NC: 2026:KHC:19619 CRL.P No. 5352 of 2026 2. That being aggrieved by the registration of the FIR. Petitioner have preferred the above criminal petition. 3. That the petitioner and the 2nd respondent marriage solemnize on date 23/05/2026 in Kanakapura Masthamma Kalyanamantappa and the engagement between the petitioner and the 2nd respondent was celebrated on 8/2/2026. 4. That upon intervention of well-wishers of the petitioner and the respondent No.2 they have amicably settled the matter and the 2nd respondent do not have any objections to quash the proceedings against the petitioner. 5. That the settlement arrived between the parties are out there free will, there is no coercion or force, fraud or any undue influence in settling the case. Wherefore the petitioner, 2nd respondent most humbly pray that this Hon'ble Court may be pleased to permit the to compound the case and quash the proceedings against the petitioner in Crime No. 0474/2025 for the offence punishable under section 318(4), 64, 352 of BNS, on the file of XXIV Addl Chief Judicial Magistrate Court Bengaluru City FIR registered by govindaraja Nagar police in the interest of justice.” In the light of the afore-quoted joint memo, as the dispute between the parties is going to end up by the petitioner and respondent No.2 in marriage, I deem it appropriate to accept the application, affidavit of respondent No.2 and the joint memo and terminate the proceedings against the petitioner. - 5 - HC-KAR NC: 2026:KHC:19619 CRL.P No. 5352 of 2026 6. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The impugned crime in Crime No.474/2025, pending before the XXIV Additional Chief Judicial Magistrate, Bengaluru, stands quashed, subject to the condition that, in the event, the marriage would not take place on the date indicated in the joint memo, the subject crime would stand automatically revived.
