Heard Mr. M Hoque, the learned counsel appearing for the petitioner. Also heard Mr. R J Baruah, the learned Additional Public Prosecutor appearing for the State of Assam.
2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner Dhiraj Das has prayed for releasing him on bail after he was arrested in connection with Sonapur P.S. Case No.25/2026.

3. The deceased Shiva Chouhan, aged about 19 years, was in love with a girl. He went to her village on the day of occurrence. Some people of the village assaulted Shiva Chouhan, as a result of which, he died.
4. Mr. Baruah has submitted that the present petitioner had assaulted the deceased along with some other persons and many persons are yet to be arrested.
5. Mr. Hoque has submitted that the petitioner has been unnecessarily implicated in the aforesaid case because he was not present at the place of occurrence.
6. I have considered the submissions made by the learned counsels of both sides.
7. The case diary shows that there are incriminating materials against the present petitioner.
8. Therefore, this Court is of the opinion that at this stage, the petitioner does not deserve to be released on bail.
9. The bail application of the petitioner is rejected and stands disposed of accordingly. The CD shall be returned. JUDGE Comparing Assistant
