Learned advocate appearing for the petitioner submits that petitioner has been implicated in the present case on the accusations of recovery of 41.950 Kgs. of Ganja from the joint possession of the petitioner and another. Petitioner is in custody since a period of 8 months. As such, he may be released on bail. Learned advocate for the State, on the other hand, submits that the charges are yet to be framed. Having considered that the rigors of Section 37 of the NDPS Act is attracted, at this stage, I am not inclined to release the petitioner on bail. 2 Petitioner will renew his prayer for bail after the evidence of the seizure list witnesses are over. Consequently, CRM (NDPS) 564 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
