O R D E R This Writ Petition is filed seeking the following relief:
“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of respondents, specifically on the part of respondent No.4 in not taking appropriate steps on representation dated 11.09.2025 submitted for removal of illegal encroachment made by the respondent Nos.5 to 8, on the Panchayat road and its margin situated in the southern side of petitioner’s agricultural landed property, admeasuring Ac.5.17 cents in Sy.Nos.188/1, 188/2, 188/3A, 188/3B/1, 188/4 (LP.No.893) of Mudugupolavaram Village, Veeravasa Mandal, West Godavari District, as illegal, arbitrary, irrational and violation of provisions of the Andhra Pradesh Panchayat Ra Act, 1994 and Rules framed thereunder and Articles 14, 21 and 300A of the Constitution of India, and consequently, direct the respondents, specifically 4th respondent to take appropriate steps to prevent such illegal encroachments on the said Panchayat road and its margin ensuring unhindrance access to the petitioner’s property in accordance with law and pass such other order or orders …”

Grievance of the petitioner is that he is the absolute owner and lawful possessor of an aquaculture field situated in an extent of Ac.5.17 cents covered by Sy.Nos.188/1, 188/2, 188/3A, 188/3B/1, and 188/4 (LP.No.893) of Mudugupolavaram Village, Veeravasa Mandal, West Godavari District, having succeeded from his ancestors; that to the southern side of the said property, a road vested with 4th respondent, leading to agricultural fields of local farmers, exists, and the said road was also being utilized by the residents of the village for ingress and egress. (b) While so, the respondent Nos.5 to 8 have illegally encroached a substantial portion of the aforesaid road, raised a thatched house and are utilizing it as cattle shed and causing serious inconvenience by blocking the road and also the ingress and egress. The respondent Nos.5 to 8 were dumping the garbage and animal waste into the petitioner’s aquaculture field and was causing serious financial loss to him. The petitioner brought the issue of encroachment to the notice of 4th respondent by way of several representations and recently on 11.09.2025, and requested him to remove the said encroachment preventing the respondent Nos.5 to 8 from creating further nuisance. Hence, the Writ Petition. 3. Today when the matter has come up before this Court, learned Standing Counsel for Gram Panchayat, on written instructions submitted by the District Gram Panchayat Officer, West Godavari District, Bhimavaram-3rd respondent, submits that the Panchayat Secretary of Rayakuduru Gram Panchayat issued notices to the respondent Nos.5 to 8, especially to 5th respondent, on 24.06.2025 and 02.07.2025 instructing them to control the garbage and to remove thatched shed from the place of Kaluva poramboke situated in R.S.Nos.109 and 120 of Rayakuduru village. He further submits that the Panchayat Secretary, Rayakuduru Gram Panchayat also issued a notice on 31.07.2026 to 5th respondent to vacate the encroachment of

thatched shed within seven days from the date of receipt of the notice, or else, the Gram Panchayat would take appropriate action in removing the same.
Learned Standing Counsel further submits that the thatched shed erected in R.S.Nos.109 and 120 Kaluva Poramboke of Rayakuduru village, is no doubt an illegal/unauthorized encroachment made by 5th respondent and it would be removed by following the norms as per law and by giving opportunity of hearing to respondent Nos.5 to 8 and a speaking order will be passed at the earliest in accordance with G.O.Ms.No.188, dated 21.07.2011. The written instructions are placed on record. 4. Placing the submission made by the learned Standing Counsel for Gram Panchayat on record, the Writ Petition is disposed of, directing the respondent Nos.3 and 4 authorities to take steps in accordance with law. There shall be no order as to costs of the Writ Petition. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed. JUSTICE K.
