In the High Court of Uttarakhand, the present case arises from Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking regular bail for the Applicant Mohd Arsh, who has been accused in Case Crime/FIR No.417 of 2025, dated 22.09.2025, under Sections 191 (2), 191 (3), 121 (1), 132, 221, 352, 351 (2), 324 (2), 190, 196 (ga) and 109 of the Bharatiya Nyaya Sanhita 2023, and under Section 7 of the Criminal Law Amendment Act, at Police Station Kashipur, District Udham Singh Nagar. The Applicant is in judicial custody since 25.09.2025. 4. Learned counsel for the Applicant submits that the co- accused has been enlarged on bail by this Court. 5. Considering the overall facts and circumstances of the case and the fact that co-accused was granted bail by this Court, the Applicant has made out a case for bail. 6. Accordingly, bail application is allowed. It is directed that the Applicant – Mohd Arsh, who has been accused in Case Crime/FIR No.417 of 2025, dated 22.09.2025, under Sections 191 (2), 191 (3), 121 (1), 132, 221, 352, 351 (2), 324 (2), 190, 196 (ga) and 109 of the Bharatiya Nyaya Sanhita 2023, and under Section 7 of the Criminal Law Amendment Act, at Police Station Kashipur, District Udham Singh Nagar, on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the concerned court.
