In Re : Manoj Sharma @ Guddu Sharma
... Petitioner.
Mr. Asraf Mandal
... For the Petitioner.
Ms. Subhasree Patel, Ms. Jonaki Saha
... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 4 months and till date, only five witnesses have been examined out of 23 witnesses cited by the prosecution in the charge-sheet. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that prosecution intends to examine another seven vulnerable witnesses. Records reflect that the petitioner is the sole accused who was seen fleeing away immediately after the incident. Prosecution is directed to conclude the aforesaid seven witnesses within a period of six months from the next date so fixed. Learned Trial Court would fix requisite number of schedule for completion of evidence of seven witnesses cited by the prosecution within the said period.
2 Petitioner will renew his prayer for bail after the examination of seven vulnerable witnesses is over. At this stage, the prayer for bail of the petitioner is rejected. Learned advocates for the petitioner and the State will communicate this order to the learned Trial Court for taking necessary action. The application for bail, being CRM (M) 2072 of 2025, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
