By means of this writ petition, petitioner has sought the following reliefs:- “i) Issue a writ, order or direction in the nature of certiorarified mandamus commanding / directing the Respondent No. 1 to produce entire record before this Hon’ble Court pertaining to the application U/S 14 of SARFAESI Act filed by Respondent Bank before Respondent No. 1 and process for the same is initiated vide communication Letter No. 759/Reader/SARFAESI Act/2026 dated 06-05- 2026 issued by Respondent NO. 1 (Annexure No. 8, Page No. 44) and thereafter quash the impugned order passed by Respondent No. 1 on the application U/S 14 of the SARFAESI Act filed by Respondent Bank. ii) Issue a writ, order or direction in the nature of mandamus commanding / directing the Respondent No. 1 not to proceed further and/or take any action on the application U/S 14 of the SARFAESI Act filed by Respondent Bank before Respondent No. 1. 5. Learned counsel for the bank, however, submits that this is the third writ petition by the petitioner for the same relief. UKHC010098312026 2026:UHC:4928 6. Learned counsel for the petitioner submits that there is an order of status quo passed by Division Bench, therefore, the bank cannot proceed with the Section 14 proceedings. 7. Learned counsel for the bank, however, submits that petitioner has moved an application before the Division Bench in the pending Special Appeal, therefore, the proper remedy for the petitioner would be to pursue that application. 8. This Court finds substance in the said submission. Since the Division Bench is ceased of the matter, therefore, this Court cannot entertain this writ petition, wherein identical relief has been sought. 9. The writ petition is, accordingly, dismissed.
