Though notice has validly been served upon the opp. party no. 2 but no one turns up on behalf of the opp. party no. 2 in spite of repeated calls. This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of CrMP No. 1645 of 2024 to its original file. Learned counsel for the petitioners submits that the CrMP No. 1645 of 2024 was dismissed for non-prosecution vide order dated 1645 of 2024. Learned counsel for the petitioners submits that as the case could not be marked, hence, the conducting counsel for the petitioners could not attend the case, which resulted in dismissal of CrMP No. 1645 of 2024. It is further submitted that the petitioners have very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that CrMP No. 1645 of 2024 be restored to its original file. Learned Addl. P.P. has no serious objection for the prayer of restoration. Considering the facts of the case and the aforesaid submission of the learned counsel for the petitioner, CrMP No. 1645 of 2024 is restored to its original file to the stage, at which, it was before its dismissal.
