Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents no.3 and 5 not to interfere and not to disposes the petitioners from their respective house sites properties in respect of: • Sy.no. 418-1 Cl for an extent of Ac.0-10 vide. ORDER
Heard Sri K.Aravind, learned counsel representing Sri K.Srinivas,
learned counsel for the petitioners and Sri Divya Teja, learned Assistant Government Pleader for Revenue for the respondents.

Petitioners, 5 in number, file the above writ petition to declare the action of the respondents 3 to 5 in attempting to dispossess the petitioners from an extent of Ac.0.10 cents each in S.No.418-1C1 of Thumucherla village, Kanaganapalle Mandal, Anantapur District, without issuing any notices, as illegal and arbitrary.

Learned counsel for the petitioners would submit that the petitioners have been in possession and enjoyment of the aforementioned extents of land. The then Tahsildar issued possession certificates, and the copies of the possession certificates are filed as Ex.P1.

Sri Divya Teja, learned Assistant Government Pleader for Revenue for the respondents, on instructions of the 3rd respondent-Tahsildar, would submit that possession certificates relied upon by the petitioners are limited to the purpose of obtaining subsidy and loan from APSHCL and the authorities will follow due process in respect of the subject land.
5. Given the facts and circumstances of the case, keeping the writ petition pending and inviting a counter will not serve any purpose.

Accordingly, the Writ Petition is disposed of at the admission stage with the consent of learned counsel on either side, directing the respondents 3 to 5 not to interfere with the extent of Ac.0.10 cents each in S.No.418-1C1 of Thumucherla village, Kanaganapalle Mandal, Anantapur District, without following due procedure. No order as to costs.
It is made clear that this Court has not recorded any finding concerning the title of the petitioners, in respect of the subject land.
As a sequel, all the pending miscellaneous applications shall stand closed.
