Heard the parties.
The petitioners have been made accused in connection with Jama P.S. Case No.46 of 2025 registered for the offences punishable under Sections 303(2), 317(2), 317(5), 3(5) of the B.N.S., 2023.
Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioner was involved in theft of 29 solar panels installed in Panchayat Lagala. It is submitted that the allegation against the petitioners is false. It is next submitted by learned counsel for the petitioners that the petitioners are not named in the F.I.R. and were implicated in this case only on the basis of their self- confessional statement in Shikaripara P.S. Case No. 82 of 2025 leading to recovery of stolen computer and peripherals. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly submitted that the petitioner has been in custody since 10.10.2025 as mentioned in para-22 of the instant bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl.P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioners are
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount seach
to the satisfaction of learned J.M. Ist Class, Dumka in connection with Jama P.S. Case No.46 of 2025 with the condition that they will co- operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that they will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case.
