2. Petitioner is aggrieved by rejection of his application for issuance of Commission filed under Order 26 Rule 9 CPC.
3. Learned Trial Court has held that Commission cannot be issued for the purpose of collecting evidence for a party.
4. Having regard to the facts and circumstances of the case, the view taken by learned Trial Court cannot be faulted. Law is well settled that every party has to stand on his own feet and agency of Court cannot be used for the purpose of collection of evidence.
5. Thus, there is no scope for interference in the matter. The writ petition fails and is dismissed.
