SAJIT KUMAR MONDAL VS.
STATE OF WEST BENGAL & ORS.
Mr. D Nayak, Advocate Ms. Tanuishree Mukherjee, Advocate ……for the Petitioner Mr. Sunit Kr. Roy, Advocate
……for SSC Ms. Sanghamitra Nandy, Advocate Mr. Bidhan Biswas, Advocate
……for State
1. The petitioner is aggrieved that the application for transfer has not been disposed of by the school authority within a reasonable time. The petitioner’s further case is that there is no objection from any of the concerned authorities, specially the school inasmuch as there are more teachers in the same subject in the said school and transfer from other schools in the same subject in the school.
2. In view thereof, there is no impediment to issue a ‘No Objection Certificate’ by the school and facilitate the transfer of the petitioner,
3. In spite of service, none appears for the school authorities.
4. The school authority will issue an appropriate ‘No Objection Certificate’ and forward the same along with the requisite documents pertaining to the petitioner to the concerned DI of Schools by April 30, 2026. I make it clear that ‘No Objection Certificate’ will be issued only when there are no pending complaints, allegations or other issues of concern that may stall a transfer.
5. With the afore-stated direction, WPA/28864/2022

is disposed of. There shall, however, be no order as to costs.
