HEMALEKHA ORAL ORDER Heard learned counsel for the petitioner, learned counsel for respondent Nos.1 and 2, and the learned counsel for respondent No. 3. 2. The petitioner has approached this Court seeking to quash the notice dated 24.12.2025 issued by respondent No.1-BESCOM (Annexure-D). 3. The learned counsel for the petitioner submits that the impugned notice calling upon the petitioner to pay - 3 - HC-KAR NC: 2026:KHC:24045 WP No. 1819 of 2026 `.15,99,658/- is without hearing the petitioner and without any show cause notice. 4. Sri H.V. Devaraju, the learned counsel for respondent Nos.1 and 2 submits that the impugned notices to be treated as show cause notices, enabling the affected parties to submit their objections before the competent authority. 5. Learned counsel for the petitioner at this stage submits that the petitioner be granted time to file objections and the notice issued be treated as a show cause notice. 6. Having regard to the submission made and considering the nature of notice issued by the respondent Nos. 1 and 2, the impugned notice be treated as a show cause notice with liberty to the petitioner to file objections to the said notice. Accordingly, this Court pass the following : - 4 - HC-KAR NC: 2026:KHC:24045 WP No. 1819 of 2026 ORDER i. The writ petition is disposed of with the following directions: a. The petitioner is at liberty to file its objections to the impugned notice issued by respondent No.1-BESCOM within a period of two (2) weeks from the date of receipt of copy of this order. b. The impugned notice shall be treated as show cause notice and the competent authority shall consider the objections filed by the petitioner and pass appropriate orders in accordance with law. c. Till consideration of the objections and passing of appropriate order, the respondents shall not take any coercive steps, including disconnection of electricity to the petitioner's property. - 5 - HC-KAR NC: 2026:KHC:24045 WP No. 1819 of 2026 d.
