02/ 27.04.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Simariya P.S. Case No. 197 of 2023, registered under sections 15C/18 of the NDPS Act, pending in the Court of learned Additional Sessions Judge-I-cum- Special Judge, NDPS Cases, Chatra.

Learned counsel for the petitioner submits that petitioner happens to be owner of the Beleno Car and allegations are made that 48 kg of doda was recovered from the said vehicle. He next submits that petitioner has already sold the said vehicle to one Aditya Yadav on 21.06.2023 and the alleged occurrence has taken place on 29.10.2023. He further submits that petitioner has got no criminal antecedent which is disclosed in para 12 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that from the said vehicle 48 kg doda was recovered and petitioner is said to be owner of the said vehicle.

On query made by this Court, learned counsel for the State fairly submits that counter affidavit has been filed wherein it is stated that petitioner has got no criminal antecedent.

Annexure-2 is a document which is an agreement which suggests that stamp paper was purchased on 21.06.2023 wherein the alleged occurrence has taken place on 29.10.2023. Further, the petitioner has got no criminal antecedent which is disclosed in para 12 of the petition.

In the attending facts and circumstances of the case, the petitioner is directed to surrender before the learned court within two weeks from today and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper.
8. This anticipatory bail application is disposed of.
