1. Pursuant to the order dated 13.5.2026 passed by the Hon’ble Supreme Court in Petition for Special Leave to Appeal (Crl.) No(s). 8818/2026, the matter has been taken up and is decided today itself. 2. This Criminal Misc. Petition has been filed under Section 528 BNS for seeking following prayers: (i) Quash and set aside FIR No. 16/2024 dated 19.4.2024 (Annexure-P6) registered at Police Station: Special Police Station (SOG) District ATS & SOG for the offence under Sections 419, 420, 467, 468, 471 and 120B IPC and Sections
[2026:RJ-JP:20772] (2 of 7) [CRLMP-3237/2025] 2(c)(ii), 3 and 10 of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022 and all consequential proceedings arising therefrom qua the petitioner; (ii) In the alternative, consolidate / club (a) FIR No. 16/2024 dated 19.4.2024 (Annexure-P6) registered at Police Station: Special Police Station (SOG), ATS & SOG, (b) FIR No. 14/2025 dated 7.3.2025 (Annexure-P7) registered at Police Station: Special Police Station (SOG), ATS & SOG; (c) FIR No. 19/2025 dated 16.4.2025 (Annexure-P8) registered at Police Station: Special Police Station (SOG), ATS & SOG with FIR No. 13/2024 dated 8.4.2024 (Annexure-P1) registered at Special Police Station (SOG), District ATS & SOG, Jaipur being the principal FIR and any or other FIRs registered or which may be filed / registered in the future in respect of the similar set of facts and allegations concerning alleged irregularities or fake degrees from JS University related to the B.P.Ed. Exam, 2022 may also be clubbed with the proceedings in FIR bearing No. 13/2024, dated 8.4.2024 (Annexure-P1) registered at P.S. Special Police Station (SOG), Jaipur under

(iii) Direct the police authorities not to arrest the petitioner in (a) FIR No. 16/2024 dated 19.4.2024 (Annexure-P6) registered at Police Station: Special Police Station (SOG), ATS & SOG, (b) FIR No. 14/2025 dated 7.3.2025 (Annexure-P7) registered at Police Station: Special Police Station (SOG), ATS & SOG; (c) FIR No. 19/2025 dated 16.4.2025 (Annexure- P8) registered at Police Station: Special Police Station (SOG), ATS & SOG and any or other FIRs registered or which may be filed / registered in the future in respect of the similar set of facts and allegations concerning alleged irregularities or fake degrees from OPJS University or JS University related to the B.P.Ed. Exam, 2022 or in respect of similar set of facts and allegations as in FIR bearing No. 13/2024, dated 8.4.2024 (Annexure-P1), registered at P.S. Special Police Station (SOG), Jaipur

Learned counsel for the petitioner submits that neither the petitioner has been named nor any specific role has been assigned to him in FIR No. 16/2024 registered at Police Station: Special Police Station (SOG), ATS & SOG. He further submits that the petitioner has no direct or indirect link with the person(s) named in the FIR. He also submits that the petitioner is working
[2026:RJ-JP:20772] (4 of 7) [CRLMP-3237/2025] as a Chancellor in J.S. University and as per the J.S. University Shikohabad, Firozabad, Uttar Pradesh Act, 2015, his work is not to prepare the marks sheets / degrees and distribute the same to the students and petitioner has been falsely implicated in this matter being the Chancellor of the University.

Learned counsel further submits that there is no allegation in the FIR in question that the petitioner dishonestly induced the complainant or anyone to receive any money or any property. Neither any cheating has been done with anyone nor any wrongful loss has been caused by him to any person. He further submits that registration of multiple FIRs on the same set of facts is impermissible in law. Therefore, he has prayed to quash FIR No. 16/2024. 5. Learned PP appearing for the State submits that the petitioner is working as a Chancellor / Controlling Authority in J.S. University and he is fully responsible for the work being discharged by its subordinate employees. He further submits that the petitioner was an active and knowing participant in the said criminal conspiracy of preparing and distributing the forged marks sheets / degrees and he misused his official position and authority to facilitate the issuance of forged marks sheets / degrees. During investigation forged degrees were also recovered from his instance. He further submits that the petitioner is the account holder of J.S. University in Canara Bank, wherein students deposited fees and a huge cash transaction has been made in the bank account of the petitioner. He further submits that in J.S. University, total 400 students could be admitted in B.P.Ed. Course (100 students for the academic session 2017-19, 100 students for
[2026:RJ-JP:20772] (5 of 7) [CRLMP-3237/2025] the academic session 2018-20, 100 students for the academic session 2019-21 and 100 students for the academic session 2022- 22), but beyond the santioned strength, total 2067 students have been issued B.P.Ed. degrees. He further submits that in FIR No. 16/2024 Ramesh Kumar was given forged B.P.Ed. degree by J.S. University without his admission in any academic session and in the FIR in question, investigation is still pending; after arrest of accused Ramesh Kumar, interrogation from the petitioner is to be made. Thus, he has prayed to dismiss the petition. He placed on record the factual report dated 20.4.2026, which is taken on record. 6. I have heard learned counsel for the parties and carefully perused the relevant material on record. 7. In the factual report dated 20.4.2026, it is mentioned that petitioner is the Controller / Chancellor and main trustee of the University and he is responsible to maintain the income and expenditure of the University.
It is further mentioned therein that without studying in any academic session in J.S. University, Ramesh Kumar, in collusion with the office bearers of J.S. University fraudulently obtained B.P.Ed. Degree in back date and that false degree of B.P.Ed. was used by him in PTI Recruitment, 2022 unlawfully. As per factual report, the matter is pending under investigation and at this stage, it may not be said that the petitioner has been falsely implicated in this matter. Thus, considering the allegations made in FIR and in view of factual report dated 20.4.2026, no case is made out in favour of petitioner to quash the questioned FIR, hence the prayer to quash the FIR is not acceptable. 8. So far the alternative prayer no. (ii) made by the petitioner for clubbing the FIRs 16/2024, FIR No. 14/2025, FIR No. 19/2025 and other similar FIRs with FIR No. 13/2024, it is revealed that after investigation, charge sheet has already been filed in FIR No. 13/2024. 9. Further from factual report, it also reveals that all the FIRs are not related to one offence and in all the FIRs, beneficiaries are different so also the cause of action. In that view, the prayer no. (ii) made by the petitioner is also not acceptable. In addition, it is clear from the perusal of the record that the petitioner has not submitted any representation before SOG for consolidating / clubbing the aforesaid FIRs. However, it is open to the petitioner to make such representation and if petitioner submits a representation before SOG in this regard, SOG is expected to pass an appropriate order; within a month from the date of receiving the representation in accordance with law, without being influenced by the order passed by this Court. 10. So far as the prayer no. (iii) made by the petitioner, not to arrest him in FIR Nos.
16/2024, 14/2025 and 19/2025 and other similar FIRs, it is not in dispute that petitioner has already been arrested in FIR Nos. 13/2024, 14/2025 and other FIR Nos. 37/2025 and 82/2024 and, as discussed above, no prima-facie case in favour of petitioner has been made out in respect of FIR No. 16/2024. 11. It is also noteworthy here that only FIR No. 16/2024 has been challenged in this petition and other FIRs have not been challenged, hence his prayer no. (iii) is also not acceptable. 12. For the aforesaid reasons, I find no force in this petition and the same stands dismissed. (BHUWAN GOYAL),J DK/8
