Mr. Rao, Advocate appearing for the petitioner does not want to press I.A. No.2/2022. 3. Accordingly, I.A. No.2/2022 is hereby disposed of. 4. Heard. 5. The petitioner has filed this petition seeking following relief(s) : “10.1. That, this Hon'ble Court may kindly be pleased to set- aside order dated 10.09.2022 (Annexure P/1) whereby the petitioner has been transferred to Govt. Higher Secondary School Dodrepal, Bakawand, District Bastar (C.G.). REKHA SINGH -2- 10.2. That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to work in the present place of posting i.e. Accountant, Block Education Officer, Bakawand, District Bastar (C.G.). 10.3. That, this Hon'ble Court may kindly be pleased to grant any other relief as it may deems fit and appropriate.” 6. Mr. Rao, Advocate would submit that the petitioner, who is working on the post of Accountant was transferred from Block Education Office Bakawand, District Bastar (C.G.) to the Government Higher Secondary School Dodrepal, Bakawand, District Batar (C.G.) on administrative ground. He would further submit that at the transferred place, post of Accountant was not available and thereafter, junior to the petitioner has been posted on the said post. He would submit that interim order is operating in favour of the petitioner since 12.10.2022. It is also informed by Mr. Rao that the petitioner is going to retire within 2-3 months on account of attaining age of superannuation. 7. On the other hand, learned Government Advocate appearing for the State would oppose the submissions. 8. Heard the learned counsel appearing for the parties and perused the documents placed on record. 9. In the return, there is no whisper as to whether the post of Accountant existed at transferred place or not. 10. Taking into consideration the above-discussed facts, the transfer order dated 10.09.2022 is hereby quashed. Accordingly, this petition is allowed. 11. Interim order granted earlier is hereby vacated.
