JUSTICE ANJAN MONI KALITA ORDER 01.06.2026 Heard Mr. M. Hoque, learned counsel appearing for the accused applicant and Mr. B. Sarma, learned Addl. PP for the State of Assam. 2. The instant aniticipatory bail application has been filed under Section 482 of BNSS, 2023 praying for grant of pre-arrest bail to the accused applicant who is apprehending arrest in a probable case that may be lodged againsgt the accused applicant. 3. A coordinate bench of this Court vide order dated 26.05.2026 has directed the Officer-in-Charge of Kharupetia Police Station to submit a report as to whether a criminal case has been registered against the accused applicant i.e. Joynal Abdin. 4. In terms of the aforesaid direction, a WT Message dated 30.05.2026 has been sent by the Officer-in-Charge to the office of Public Prosecutor, Gauhati High Court, which has been produced by the learned Addl. PP before this Court. 5. The aforesaid WT Message reveals that no FIR and/ or any criminal case has been registered against the accused applicant in the instant case. 6. The aforesaid report (WT Message) is kept on record by marking “X”. 7. Taking into account the aforesaid report, which reveals that no FIR has been lodged against the accused applicant, this Court is of the considered opinion that there is no apprehension of arrest of the accused Page No.# 3/3 applicant, at this stage.
