And In the matter of : Uttam Pati. ……Petitioner. Mr. Arnab Chatterjee Mr. Abhinava Mukherjee Ms. Debolina Roy .....for the Petitioner. Ms. Anasuya Sinha, Ld. APP Mr. Ashok Das ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody since March, 2024 and there has hardly been any progress in the case and the petitioner is languishing in jail for the last two years. Learned advocate for the State on the other hand opposes the prayer for bail and submits that the incident complaint of is of the year 2014, charge-sheet was submitted subsequently. Petitioner was granted bail by the Hon’ble High Court, petitioner pursuant to his release on bail did not take steps before the learned trial Court and as such on the execution of warrant of arrest he was arrested in the month of March, 2024. Petitioner himself has contributed to the delay and presently is praying for bail. Having considered the conduct of the petitioner and stage of the case which reflect that out of 31 witnesses proposed to be 2 examined 17 witnesses have been examined, I am not inclined to release the petitioner on bail at this stage. Learned trial Court would put in efforts so that the trial is taken to its logical conclusion by 31st of December, 2026. With the aforesaid observations CRM (M) 2343 of 2025 is dismissed. Learned advocate for the State would communicate the order to the learned trial Court preferably within a period of seven days from date. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
