ORDER:
The writ petition is filed under Article 226 of the Constitution of India, to issue a writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the action of the respondent Nos. 3 and 5 in trying to dispossess / interference with the petitioner’s peaceful possession and enjoyment at the instance of the respondent No. 6 for the agriculture land situated in Sy.Nos. 269-2B, 266-4, 132-4, 127-3 and 127-10 respectively to an extent of Ac. 1.31 cents of Bhimavarapukota Village, Kotananduru Mandal, Kakinada District is highly illegal, arbitrary, unconstitutional, violation of Articles 14 and 300-A of the Constitution of India; and consequently direct the respondents Nos.3 and 5 not to dispossess interfere with the petitioner peaceful possession and enjoyment at the instance of the respondent No. 6 for the subject land and to pass such other order as this Court deems fit. 2. The case of the petitioner, briefly stated, is as follows: a. The petitioner was in peaceful possession and enjoyment of the subject property having inherited the same by virtue of a registered settlement deed document No. 10337 of 2025, dated
11.08.2025. The respondent No. 6, the brother of the petitioner and adapted by his uncle, having political influence, has been harassing the petitioner and his parents seeking a share in the subject property. The petitioner and his parents made complaint to the respondents Nos. 2 to 4 through P.G.R.S. on 20.07.2026. b. While so, on 01.08.2026, at the behest of the respondent No. 6, the V.R.O. by name Suryanarayana, directed the petitioner to appear before the respondents Nos. 3 and 5 and threatened to

settle the matter with the respondent N. 6. Due to non-consideration of the complaint, dated 20.07.2026, the petitioner and his parents are fearing threat of dispossession. Hence, this writ petition was filed. 3. Sri G. Divyatheja, learned Assistant Government Pleader for Revenue, placed on record a copy of written instructions of the respondent No. 3, vide Ref.A / 158 / 2026, dated 10.08.2026, along with a copy of the complaint said to be given by the brother of the petitioner and the statement allegedly recorded from the father of the petitioner.
It is stated in the written instructions as below:
“The complaint in P.G.R.S. that the subject land belongs to his father, Sri Yamala Ramulu and his younger brother Sri Yamala Appala Naidu obtained a registered settlement deed in respect of the said land. He requested restoration of the land in the name of his father. On receipt of the grevience, the Village Revenue Officer, Bhimavarapukota under the office of the Tahsildar, Kotananduru, conducted a simple enquiry and recorded the statement of the father of the petitioner. Except for the above enquiry and recording the statement of petitioner’s father, no further action has been taken by this office in the matter. This office has not passed any order confirming the claim of either party, nor has any direction or instruction been issued by this office to dispossess, interfere with, or otherwise disturb the possession of the writ petitioner over the subject land as on date.”

4. Basing on the same, the learned Assistant Government Pleader for Revenue submitted that there is no interference by the official respondents as alleged by the petitioner. 5. In response thereto, the learned counsel for the petitioner requested to dispose of the writ petition by recording the written instructions as part of the order. 6. Accordingly, recording the written instructions as part of this
order, the writ petition is disposed of.
Pending miscellaneous applications, if any, shall stand closed.
