2. Mr. Pratiroop Pandey, learned AGA, for the State of Uttarakhand.
3. The present applicant – Bimal Rawat S/o Sh. Bhola Singh, is praying for bail in a reference to FIR dated 18.01.2026, bearing FIR/Case Crime No.0020 of 2026, Police Station Kotwali Haldwani, District Nainital, wherein, he along with two others, namely, Ruby Rawat and Anoop Kandari, have been implicated for the offences punishable under Sections 316 (5), 318, 3 (5) of BNS, 2023 read with Section 3 of Uttarakhand Depositors Interest Protection (in Financial Institutions) Act, 2005.

Learned counsel for the applicant argued that the applicant is innocent and has been implicated and in fact before the maturity period the FIR has been lodged by the complainant, who was the investor. Apart from this, he submits that present applicant is languishing in jail since 19.01.2026, and the other co-accused who is the wife of the applicant has been granted interim protection and all the offences are triable by Magistrate and the applicant have no previous criminal antecedents.
5. On the other side Mr. Pratiroop Pandey, learned AGA, submits that the investigation is going on, however, he has not disputed the fact that the present applicant is languishing in jail since 19.01.2026, and have no previous criminal antecedents and all the offences are triable by Magistrate.
6. After hearing the arguments of the learned counsel for the parties, and taking into
consideration that all the offences are triable by Magistrate and the applicant have no criminal
antecedent, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merits of the case, the bail application is allowed.
8. Let the applicant – Bimal Rawat, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned.
