JUSTICE PRAVEER BHATNAGAR
Order 13/05/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 36/2026 registered at Police Station Kherli, District Alwar for the offences under Sections 5, 6, 8 and 9 of Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Act.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that there is no substantive evidence available on the record indicating the fact that the petitioner was transporting the bovine animals on 18.01.2026 in vehicle bearing No. RJ-32-GC- 3874, which was recovered in abandoned condition with the bovine animals. The owner of the said vehicle is Julahid, who is still not been arrested and petitioner has been arrested solely on
[2026:RJ-JP:20317] (2 of 3) [CRLMB-5713/2026] the basis that in another case bearing No. 84/2026 registered under Sections 3, 5, 6, 8 and 9 of the RB Act, it was allegedly revealed during interrogation that the petitioner had previously also transported bovine animals. Apart from that there is no evidence available on the record and interrogation note is not admissible against the petitioner. The accused-petitioner is in custody since 19.03.2026 and the trial of the case may take considerable time, therefore, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that petitioner is a habitual offender and against him a case bearing No. 84/2026 under bovine animal Act was registered, therefore, considering the above facts, his bail application deserves to be dismissed. 4. Heard and perused the material available on record. 5. Apart from the information rendered in another case, there is no substantive evidence available on the record that petitioner was transporting the bovine animals in vehicle No. RJ-32-GC-3874 and owner of the vehicle was found to be Julahid who is absconding and investigation against him is pending. The accused- petitioner is in custody since long and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Vaseem Khan S/o Hanif Khan, in connection with FIR No. 36/2026 registered at Police Station Kherli, District Alwar shall be enlarged

In case if the petitioner changes his address or mobile number, he shall submit the same before the concerned SHO so also before the concerned learned trial court. 9.
