Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 483 of the Bharatiya Nagarik mnSuraksha Sanhita, 2023, whereby the petitioner, Pramila Choudhury has prayed for releasing her on bail after she was arrested in connection with Dispur P. S. Case No.121/2026, under Section 103(1)/238/3(5) of the BNS, 2023. Page No.# 2/2 3. The husband of the present petitioner attacked her with a knife and a hammer. On seeing that, her son intervened. There was a scuffle between the father and the son and the father sustained knife injuries as a result of which he expired. After that the mother had washed off the hammer and the knife used by her son. 4. Learned counsel for the petitioner has submitted that this is an offence under Section 238 of the BNS, 2023 and the same is bailable. 5. I have considered the submissions made by the learned counsel of both sides. 6. This is a clear case of Section 238 of the BNS, 2023. Therefore, the petitioner is entitled to be released on bail. Accordingly, her bail application is allowed. 7. The petitioner, Pramila Choudhury who was arrested in connection with Dispur P. S. Case No.121/2026, under Section 103(1)/238/3(5) of the BNS, 2023 shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro) at Guwahati. 8.
