dated.16.07.2026 proposing to conduct a public auction on.28.07.2026 in respect of the petition schedule temple land ,despites the petitioners continuous possession and cultivation since 1942 ,the binding civil court judgments confirming the tenancy rights of the petitioners predecessors ,the petitioner regular payment of lease rent , and the permanent improvements made by planting lemon trees and laying pipeline as illegal , Arbitrary violative of Article 14 and 300-A of the constitution of India and contrary to the provisions of the Andhra Pradesh charitable and hindu religious institutions and endowment act, 1987 and consequently direct he respondents not to conduct the proposed auction and to renew/grant the lease in favour of the petitioner .with all consequential benefits.

ORDER:
The 4th respondent proposed to conduct auction on 28.07.2026, published a notification on 16.07.2026, inviting tenders in respect of the property in Sy.No.149 admeasuring to an extent of Acs.5.47 cents in Mudigedu Village, Podalakur Mandal, SPSR Nellore District.

Learned counsel appearing for the 4th respondent stated that the respondents are unable to conduct public auction as no bidder has come forward to participate in the auction. Learned counsel for the 4th respondent further stated that the petitioner earlier filed a Writ Petition No.7919 of 2010 and the said Writ Petition was disposed of directing the respondents not to dispossess the petitioner except in accordance with law, more specifically, under Section 83 of the Andhra Pradesh Charitable and Hindu Religious Institutions Act 30 of 1987 and to proceed in accordance with law and, accordingly, a show cause notice was issued on 18.10.2024 calling for explanation of the petitioner as to why he should not be evicted from the subject property, however, the petitioner did not issue any reply and dragged the matter and enjoying the fruits of the subject property. Therefore, the eviction order has been passed on 24.07.2026, directing the petitioner to vacate the temple land

and the petitioner has challenged the auction proceedings without any right over the property.

Learned counsel for the petitioner states that the eviction proceedings were not communicated to the petitioner. In reply to the same contention, learned counsel appearing for the 4th respondent stated that the eviction proceedings will be communicated to the petitioner.
4. Therefore, the present Writ Petition is disposed of, directing the respondent authorities to evict the petitioner in accordance with law. There shall be no order as to costs. As a sequel thereto, Interlocutory Applications pending, if any, shall stand closed.
