Learned senior counsel appearing on behalf of the petitioners submits as follows. The petitioners are some of the accused who have been charge-sheeted in this case. Although, initially 37 persons were named in the FIR, the charge-sheet has been submitted against 27 persons. The two principal accused in this case were arrested and were thereafter, granted bail. 2. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. She relies on the statements of the victim and the statements of the eye- witnesses and the injury report. Although the present petitioners have not been specifically named by the victim or the other witnesses, they have been clearly mentioned in the FIR as the assailants. 2 3. Considering the above and the other materials available in the case diary, the fact that two principal accused were arrested and were granted bail and the fact that charge- sheet has also been submitted, although I am inclined to grant anticipatory bail to the petitioners, their movements need to be restricted for a limited period of time. 4. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall not threaten or intimidate the witnesses. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date. The petitioners shall stay outside the jurisdiction of Nandigram Police Station for a period of two months except for meeting the I.O or attending the jurisdictional Court. 5. Accordingly, the application for anticipatory bail is allowed. 6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
