(2) Petitioners were engaged on contract as Medical Officer in National Health Mission in the year 2013 and 2014 respectively and their contract was renewed from time to time for one year. Petitioners are aggrieved by order dated 19.6.2018, passed by Chief Medical Officer, Udham Singh Nagar, which is on record as Annexure-8 to the writ petition. In the said order, it was provided that since petitioners did not appear for assessment in terms of direction issued by District Magistrate, therefore, it is not possible to renew their contract. By means of this writ petition, petitioners have sought the following reliefs: “(i) issue a writ, order or direction in the nature of certiorari quashing the impugned office order no. N.H.M./R.B.S.K./Samvida/Navinikaran/2018-19/111 dated 19.06.2018 passed by respondent no. 6 (Annexure No. 8 to this writ petition). (ii) issue a writ, order or direction in the nature of mandamus commanding/directing the respondents to permit the petitioners to work on the post of Medical Officer (Rashtriya Bal Swasthya Karyakram). (iii) issue a writ, order of direction in the nature of mandamus commanding/directing the respondents to make the Human Resource Policy for the employees of National Health Mission working in the State of Uttarakhand as per the guidelines issued by the Central Government time to time.” UKHC010065942018 2026:UHC:5029-DB (3) Coordinate Bench of this Court, vide order dated 3.7.2018, had passed an interim order in favour of petitioners and on the strength of that order, petitioners are still serving on contract and their contracts are being renewed on year to year basis. (4) Since the contract of petitioners has been renewed in terms of aforesaid interim order and they are still continuing, on contract, as Medical Officer, therefore, challenge thrown to the impugned order does not survive. Writ petition is, accordingly, disposed of with liberty to petitioners to make representation before the competent authority for redressal of their grievances. If petitioners make separate representation within two weeks from today, competent authority shall examine the issues and take decision, as per law, within six weeks thereafter. (Pankaj Purohit, J.)
