The present Writ Petition is filed questioning the action of Respondents in not considering Petitioner’s case for promotion to the post of Regional Transport Officer without reference to the Charge-Memo issued by Respondent No.2 vide No.20024/6/V2/2022, dated 06.03.2026 and to declare the same as illegal and arbitrary. 2. The facts in brief are as follows; The Petitioner was initially joined in service as Assistant Motor Vehicle Inspector in Transport Department on 11.03.1994 and got promotion as Motor Vehicle Inspector on 12.01.2005. While so, Respondent No.2 issued impugned Charge-Memo framing Charge against the Petitioner pursuant to surprise check by ACB officials at Transport Check Post, Penugonda alleging that the Petitioner illegally collected amount of Rs.85,670/- from drivers and cleaners of lorries passing through the Check Post on 05/06.07.2022 through two private agents. It was also alleged that an amount of Rs.47,700/- was discovered in the rack below the Computer Stand in front of Petitioner’s seat during the surprise check. 4 3. The Petitioner submitted his explanation to the Charge-Memo denying the Charges framed against him and requested to drop further action. However, no further steps have been taken by the Respondent-authorities to finalize the enquiry as per the guidelines issued by the Government from time to time to conclude the enquiries. Hence, the present Writ Petition is filed. 4. During the course of arguments, learned counsel for the Petitioner Sri Eluru Sesha Mahesh Babu submits that though the Charge-Memo is issued in the month of March, 2026, as on date there is no progress in the enquiry and he restricts his relief in the Writ Petition to the extent of promotion only and would submit that the case of the Petitioner may be considered for promotion. 5. The learned Assistant Government Pleader for Services-I Sri S. Raju would submit that the enquiry would be concluded, as expeditiously as possible, and the case of the Petitioner for promotion would be considered in terms of G.O.Ms.No.257, dated 10.06.1999. 6. Having heard the respective counsels, the Writ Petition is disposed of, with the following directions; 5 (i) The Respondents are directed to consider the case of Petitioner for promotion to the post of Regional Transport Officer subject to the Petitioner possessing requisite qualification in terms of G.O.Ms.No.257, General Administration (Ser.C) Department, Dated 10.06.1999; (ii) No order as to costs. 7.
