Since common questions of law and fact are involved in these petitions, therefore, they are being heard and decided together. However, for the sake of brevity and convenience, facts of WPMS No. 1890 of 2026 alone are being considered and discussed. 6. Petitioner has challenged notice dated 06.06.2026, issued by Mussoorie Dehradun Development Authority under Section 26A(4) of Uttarakhand Urban and Country Planning and Development Act, 1973. UKHC010107422026 2026:UHC:5004 7. Learned Senior Counsel appearing for the petitioner contends that description of the plot number is wrongly given in the notice. He further submits that petitioner is bhumidhar of the land in question, therefore, the allegation that petitioner is in encroachment over the said land is incorrect. 8. Per contra, learned counsel appearing for the Mussoorie Dehradun Development Authority submits that writ petition is premature, as only a notice has been given to the petitioner and petitioner has opportunity to have his say by filing his reply. 9. This Court finds substance in the said contention raised on behalf of the Mussoorie Dehradun Development Authority. 10. Since petitioners have opportunity to submit reply and petitioners have, in fact, submitted such reply, as stated by learned Senior Counsel for the petitioners, the writ petitions are disposed of by permitting the competent authority in Mussoorie Dehradun Development Authority to consider petitioners’ reply and pass appropriate order, as per law, within four weeks from the date of presentation of certified copy of this order. For a period of four weeks or till decision is taken by the competent authority status quo as regards the structure raised by petitioners shall be maintained.
