ORAL ORDER
Learned counsel for the petitioner is present and
learned counsel for the respondent is absent.
2. Heard the arguments of learned counsel for the petitioner.
3. This civil petition is filed by the wife for transfer of M.C.No.946/2025, filed by the husband for divorce, from III Additional Principal Judge, Family Court at Mysuru to the Principal Senior Civil Judge, Chitradurga.
4. It is stated that the petitioner is a Dentist. Her marriage with respondent was performed in the year
2025. Presently, she is residing along with her parents and pursuing her higher studies at Chitradurga. The distance between Chitradurga and Mysore is 258 kilometres. It is further stated that husband is a business man and also having agricultural income. The petitioner has also filed a petition in MC No.229/2025 on 12.11.2025 for restitution

of conjugal rights. Admittedly, both the petitions filed for divorce and restitution of conjugal rights have to be filed together before the same Court to avoid conflict in decisions. Therefore, this Court finds that it is just and reasonable to transfer the petition in M.C.No.946/2025 filed by husband for divorce before the III Additional Principal Judge, Family Court, Mysuru to the Principal Senior Civil Judge, Chitradurga to try along with MC No.84/2024 and dispose of both the matters at a time.
5. The Family Court is specifically directed not to insist on the personal presence of the respondent unless there is any specific requirement. He is at liberty to file his chief affidavit and he can be cross-examined through a Commissioner or by way of video conferencing facility. With these observations, the Civil Petition is allowed.
