GP FOR REVENUE The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.20930 OF 2026 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANADAMUS declaring the inaction of the 3rd respondent in disposing the representations Dated 02.02.2026, 21.04.2026 and 06.05.2026 of the petitioner as illegal, arbitrary and violation of the Provisions of The Maintenances and Welfare of Parents and Senior Citizens Act, 2007 and Article 21 of the Constitution of India and against the principles of natural justice and consequently direct the 3rd respondent to take appropriate action to vacate the 5th respondent from the house of the petitioner and to pass such other order or orders.…” 2. Heard learned counsel for the petitioner and Sri P.L.V.S.Prasad, learned Assistant Government Pleader for Women Development and Child Welfare. 3. On perusal of the affidavit filed in support of the writ petition, it appears that the petitioner herein submitted representations dated 02.02.2026, 21.04.2026 and 06.05.2026, to the 3rd respondent-Revenue Divisional Officer with a request to take appropriate action against the 5th respondent. However, the 3rd respondent has not taken any action. Hence, the present writ petition has been filed to direct the 3rd respondent to take appropriate action on the petitioner’s representations. 4. Section 5 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (for short ‘the Act’) envisages that cognizance of a 4 complaint can be taken only on an application made to the concerned authority or under Section 5(c) of the Act, the Tribunal may take cognizance suo motu. 5. Therefore, the present Writ Petition is disposed of at the admission stage, directing the 3rd respondent to treat any one of the representations, dated 02.02.2026, 21.04.2026 and 06.05.2026, as an application under Section 5 of the Act, issue notice to the respondents therein, follow the procedure contemplated under the Act, and dispose of the same, in accordance with law, as expeditiously as possible. There shall be no order as to costs.
