JUSTICE ANJAN MONI KALITA ORDER 01.06.2026 Heard Mr. YS Mannan, the learned counsel appearing on behalf of the accused applicants. Also heard Mr. DP Goswami, the learned Additional Public Prosecutor, Assam appearing for the State respondents. 2. This is an application under Section 482 of BNSS praying for granting pre- arrest bail to the accused applicants in connection with Golaghat Police Station Case No.162/2025 under Sections 61(2)/318(2)/316(4)/336(3) of the BNS, 2023. 3. The gist of the facts involved in the instant case is that an FIR was lodged on 27.08.2025, which reveals that petitioner No.1, being an employee of a company namely Rangdoi Tea Company had allegedly misappropriated money, forged documents and committed breach of trust, and had unauthorizedly transferred company’s funds to his personal account without any approval of the management of the company. It is also alleged in the FIR that the family members of the accused applicant No. 1 were also involved in the aforesaid misappropriation. 4. The instant anticipatory bail application has been filed by the accused No.1 Page No.# 3/3 along with his other family members. 5. Vide an order dated 05.09.2025, a Coordinate Bench of this Court has already granted interim pre-arrest bail to the accused applicants with a direction to the accused applicants to cooperate with the investigation as well as to appear before the Investigating Officer within a period of 7(seven) days from the said order i.e. 05.09.2025. 6. Mr. Y.S. Mannan, the learned counsel appearing for the accused applicants submits that in terms of the interim order dated 05.09.2025, the accused applicants have already appeared before the Investigating Officer and got their statements recorded. Mr. Mannan, the learned counsel, therefore, submits that since the accused applicants are cooperating with the investigation and they are going to do so in future, the custodial detention of the accused applicants is not required in the instant case, and, accordingly, prays for making the interim order dated 05.09.2025 absolute. 7. Mr. DP Goswami, the learned Additional Public Prosecutor has also confirmed that the accused applicants have appeared before the Investigating Officer and have been cooperating with the investigation. 8. Taking into account the aforesaid submissions and the fact that the accused applicants are cooperating with the investigation, this Court is of the considered view that the interim pre-arrest bail so granted on 05.09.2025 should be made absolute. 9. Accordingly the instant anticipatory bail application stands disposed of by making the interim order dated 05.09.2025 absolute. JUDGE Comparing Assistant
