The petitioners are apprehending their arrest in connection with Barkagaon P.S. Case No.200/2025, registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 109(1), 132, 352, 351(1) of the BNS, pending in the Court of the learned Judicial Magistrate, Hazaribagh. At the outset, learned counsel appearing for the petitioners in light of allegations made against petitioner no.1, namely, Vinay Vikash @ Vikash Mahto, petitioner no.3, namely, Ravi Kumar @ Ravi Kumar Dangi and petitioner no.6, namely, Dinesh Saw @ Dinu, seeks permission to withdraw this application so far as aforesaid petitioners are concerned. 4. Learned counsel appearing for the State has got no objection. 5. Accordingly, this application is dismissed as withdraw so far as petitioner nos. 1, 3 and 6 are concerned. 6. Learned counsel appearing for petitioners submits that so far as petitioner nos.2, 4, 5, 7, 8 and 9 are concerned, they are local resident and there is dispute between felicitator of land to the NTPC and land losers with regard to various issues in which the said petitioners used to raise their voice against the said company and in view of that, they have been implicated in the present case. He further submits that so far allegation of assault on driver and snatching gold chain and Rs.40,000/- are concerned the same is against four named persons namely Arjun Rana, Ravi Kumar @ Ravi Kumar Dangi (petitioner no.3), Vinay Vikash @ Vikash Mahto (petitioner no.1) and Dinesh Saw @ Dinu (petitioner no.6). He next submits that the prayer for anticipatory bail of the co-accused persons has been allowed by this Court in A.B.A. No.572 of 2026. 7. Learned counsel appearing for the State opposed the prayer and submits that the said petitioners were present on the spot. 8. Considering that petitioner nos.2, 4, 5, 7, 8 and 9 are the local resident and it appears that there is dispute between felicitator of land in favour of NTPC and land losers and for that the said petitioners were agitated and the ( 2026:JHHC:12096 ) -1- A.B.A. No. 1974 of 2026 prayer for anticipatory bail of co-accused persons has been allowed by this Court in the aforesaid A.B.A. and in that view of the matter, the petitioner no.2, namely, Kailash Kumar @ Kailash Mahto, petitioner no.4, namely, Govind Mahto, petitioner no.5, namely, Kalicharan Kumar, petitioner no.7, namely, Md. Sadik @ Md. Sadik Kuraishi, petitioner no.8, namely, Birendra Mahto and petitioner no.9, namely, Sitaram Saw are directed to surrender before the learned Court within two weeks and the learned Court shall release the said petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper. 9.
