Kalita, learned counsel appearing for the accused applicant and Mr. P. S. Lahkar, learned Addl. PP for the State of Assam. 2. This is an application filed under Section 482 of BNSS, 2023 praying for granting pre-arrest bail to the accused applicant in connection with Jalukbari P.S. Case No.94/2026 under Sections 112 (2)/303 (2)/317/61 of BNS, 2023. 3. An FIR was lodged by one Mainuddin Sheikh before the Jalukbari Police Station alleging that he is the care taker of Goshala owned by one Yakub Ali; that 2 (two) persons, namely, Soleman Ali and Jakir Ali came to Goshala and stayed there for some time; that both of them came and stayed at Goshala and on the next morning, he found that 19 cattles were missing from Goshala. 4. On receipt of the FIR, Police registered Jalukbari P.S. Case No. 94/2026. 5. On completion of the investigation, police found that in fact the missing cattles were sold by the owner of the Goshala, namely, Yakub Ali to the aforesaid Soleman Ali and Jakir Ali. 6. The Case Diary in the instant case has been produced before this Court and the same is perused. 7. The learned counsel appearing for the accused applicant submits that Page No.# 3/3 the accused applicant Jakir Ali is only a friend of aforesaid Soleman Ali. He submits that the accused applicant is no way linked with the selling of the cattles. 8. On perusal of the Case Diary, this Court finds sufficient incriminating materials against the accused applicant and therefore, the prayer for extending pre-arrest bail to the accused applicant stands rejected, at this stage. 9. In view of the above directions, this anticipatory bail application stands disposed of. Case Diary be returned, forthwith. JUDGE Comparing Assistant
