No. 5809/2026 The present interlocutory application has been filed seeking condonation of delay of 41 days in filing the present C.M.P. 2. Having heard learned counsel for the parties and for the reasons assigned in the present interlocutory application, the delay occurring in filing of the present C.M.P is condoned. 3. The present interlocutory application stands disposed of. C.M.P. No. 854 of 2019 4. The present C.M.P has been filed for restoration of C.M.P. No. 393/2018, which got dismissed for non-compliance of the peremptory order dated 16.08.2019. 5. Having heard learned counsel for the parties and considering the statements made in the present C.M.P, C.M.P. No. 393/2018 is ordered to be restored to its original file and stage, subject to the conditions that the petitioner shall pay a cost of Rs.2,000/- in favour of the Advocates Clerk Welfare Fund, High Court of Jharkhand, Ranchi and shall remove the remaining defect(s) pointed out by the office by 08.05.2026. 6.
