This bail application has been filed on behalf of Manoj Lohra who is in custody since 06.08.2025 in connection with Chandwa P.S. Case No. 180 of 2025 for the offence registered under Section 64(2)(m) of the BNS pending in the Court of learned A.C.J.M., Latehar. As per the F.I.R., consensual physical relationship continued for three years. It is submitted by the learned counsel on behalf of petitioner that the prosecutrix is a married lady, aged 30 years, with three children. It is argued by the learned counsel for the petitioner that the offence alleged will not be made out as the prosecutrix was a married lady and therefore, it cannot be said that physical relationship was established on false promise of marriage. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
