Haloi, learned counsel for the petitioner. Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in respect of Sessions Case No.107/2023, pending in the Court of the learned Sessions Judge, Sonitpur, Tezpur. 3. The petitioner, Rana Das is an accused before the Trial Court of the learned Sessions Judge, Sonitpur, Tezpur. Since 15.11.2025, the petitioner was absent in the Page No.# 2/2 Court. Therefore, the Trial Court was directed to issue a Non Bailable Warrant against him. The petitioner was accordingly arrested and remanded to custody. His bail application was also rejected on the ground that the petitioner was absent in the Court since 15.11.2025. 4. The petitioner submits that he had to go to Arunachal Pradesh in search of livelihood and he informed his lawyer about his stay at Arunachal Pradesh. But his lawyer did not taken steps on his behalf. 5. I have considered the submissions made by the learned counsel for both sides. 6. This Court is of the opinion that the petitioner has shown a good ground for his absence in the Court below. Therefore, he is interested in facing the trial. 7. Since the petitioner is interested in facing the trial, this Court is of the opinion that the petitioner deserves to be given adequate opportunity to that effect. Therefore, his application for bail is allowed. 8. The petitioner, Rana Das shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Sessions Judge, Sonitpur, Tezpur. The petitioner is directed to appear before the Court below regularly and if he fails to do so, the learned Court shall be at liberty to follow due process of law. 9.
