Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon’ble Court may kindly be pleased to call for entire records pertaining to the case of petitioner. 10.2 That, this Hon’ble Court may kindly be pleased to set aside the impugned order dated 29.10.2000 (Annexure P-1) and direct the respondents to pay the monetary benefit to the petitioner, treating him restated and retired from service on 31.03.2017 from the post of Superintendent Engineer and PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 calculating back wages from 29.10.2000 to 31.03.2017 with respective promotion in between in the post of Executive Engineer and Superintendent Engineer and calculating the retiral benefits accordingly and paying compound interest of 12 % on all above amount from 11.09.2025 to the date of payment, and pay all above amount to the petitioner with stipulated period, in the interest of justice. 10.3 That, any other relief/ order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.” 2. Learned counsel for petitioner submits that petitioner while working on the post of Assistant Engineer was implicated in a criminal case. Learned trial court has passed an order of conviction against petitioner and pursuant to the order of conviction of petitioner, respondents- authorities have terminated the service of petitioner. He contended that against the order of conviction, petitioner preferred an appeal before the High Court bearing CRA No. 1995/2000, whereby petitioner was acquitted from the charges. Petitioner thereafter had submitted a representation before Respondent No. 2 on 11.09.2025 and 23.09.2025, which are pending consideration. 3. Learned counsel for Resp. No. 2 submits that the representation of petitioner if pending consideration, it will be considered in accordance with law. 4. On due consideration of the facts and circumstances of the case, submission made by learned counsel for respective parties, further considering that petitioner has already submitted representation before Respondent No. 2, which is stated to be pending consideration, this writ petition at this stage is dispose off, permitting the petitioner to submit fresh comprehensive representation before Respondents No. 1 3 / 3 & 2 along with all supporting documents and if such a representation is submitted, the concerned authorities shall consider and take decision on the representation to be submitted by petitioner, in accordance with law, expeditiously, preferably within a further period of 03 months from the date of receipt of representation. 5.
