The petitioner has filed the present petition assailing the Notification dated 23.01.2026, whereby, he was transferred from HPPWD Sub-Division, Nankhari to HPPWD Sub-Division, Kholighat, vice respondent No.4. The petitioner has assailed the said transfer
order on the ground that he had not completed his normal tenure of 3- 5 years and further, respondent No.4 has been posted at his own Sub-Division, which is not permissible as per the guidelines, issued vide office memorandum dated 10.07.2013. Though, the respondents including the private respondent have opposed the relief claimed in 1 Whether the reporters of the local papers may be allowed to see the judgment?
2 ( 2026:HHC:14394 ) the writ petition, however, keeping in view the fact that petitioner had not completed normal tenure at Sub-Division Nankhari, where, he had joined in pursuance of the earlier transfer order dated 10.06.2025 on 12.06.2025, rather than, commenting on the notification dated 23.01.2026, the respondents/Competent Authority is directed to consider the posting of the petitioner in any of the station(s) of his choice, which may be furnished by him, within two weeks from today and thereafter, the Competent Authority will consider the same and post him in any of the station(s), where the person has completed his normal tenure of three years.
2. Keeping in view the above facts, the present petition is
disposed of, with a direction to the petitioner to make a detailed representation to respondent No.1, within two weeks from today and respondent No.1 shall decide the same within four weeks, thereafter. Till the time the representation made by the petitioner is decided, he is permitted to perform his duties at Sub-Division, Nankhari. The petition is accordingly disposed of. Pending miscellaneous application(s), if any, shall also stands disposed of. (Jiya Lal Bhardwaj), Judge
