1. Heard Mr. N. H. Barbhuiya, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam.
2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, Himesh Nath has prayed for releasing him on
Page No.# 2/2 anticipatory bail in respect of Katlicherra P.S. Case No.38/2026, under Section 75, 77, 318(2) and 356 of the BNS, 2023 read with Section 67(A) of the Information Technology Act, 2000.
3. The petitioner was in a relationship with a girl. One day he invited the girl to his house, where he took some nude photographs of the girl and later on he allegedly threatened her and blackmailed her with those photographs.
4. I have considered the submissions made by the learned counsel for both sides.
5. It appears that the dispute is between the girl and the boy. There is no specific allegation of sexual harassment made by the girl against the boy.
6. Considering these facts, this Court is of the opinion that the petitioner does not deserves to be detained in custody for the allegation brought against him. Therefore, his prayer is allowed.
7. It is hereby directed that in the event of arrest in connection with Katlicherra P.S. Case No.38/2026, the petitioner, Himesh Nath shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the arresting authority.
8. With the aforesaid direction, this anticipatory bail application stands disposed of. JUDGE Comparing Assistant
