JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner – de facto complainant is before this Court calling in question proceedings in S.C.No.94/2026, pending before the XLV Additional City Civil and Sessions Judge, Bengaluru, for the offences punishable under Sections 498A, 313, 323, 504, 506 r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioner and respondent Nos.2 to 4 in unison submit that the parties to the lis were before the family court in M.C.No.18/2024 and have settled - 3 - HC-KAR NC: 2026:KHC:17345 CRL.P No. 1785 of 2026 their matrimonial dispute amicably by drawing up certain terms and conditions before the mediation center. They couple have parted their ways. They are before this Court seeking permission to compound the offences. The parties have filed an application under Sections 359 r/w. 528 of the BNSS, 2023, which were Sections 320(2) r/w. 482 of the Cr.P.C.- the earlier regime before this Court to that effect. 3. The affidavit of the petitioner reads as follows: “I, Ramya @ Jalaja W/o.Sharath Kumar N aged 29 years R/at No. 23 4th Cross, Aiyappanagar, Bengaluru- 560036 do hereby solmnly affirm and state on oath as follows :- 1. I state that I am the petitioner in the above case and fully conversant with facts and circumstances of the case. 2. I state that I had lodged a complaint against respondent No.2 to 4 in Crime No.79/2024 of K.R.Puram police station, now the same is pending in S.C.No.94/2026 on the file of XLV Addl City Civil and Session Judge, at Bengaluru for the offences p/u/s.498A, 313, 323, 504, 506 r/w. 34 of the IPC. 3. I state that the respondent No.2 has filed divorce petition against me U/S 13(l)(a) of Hindu Marriage Act in M.C.No.18/2024 before 2nd Addl. Prl. Judge Family Court at Bengaluru and the same has been compromised as per the mediation agreement dated 25/04/2025. Therefore the Hon’ble trial court has granted the decree of divorce. 4. I state that I am not interested to prosecute the case against the respondent No.2 to 4 and I am voluntarily willing to withdraw the allegation in chargesheet, made against the respondent No.2 to 4. - 4 - HC-KAR NC: 2026:KHC:17345 CRL.P No. 1785 of 2026 Therefore, I pray this Hon’ble court be pleased to permit myself and respondent No.2 to 4 to compromise the case and quash the entire proceedings mentioned in the accompanying application.” In the light of the fact that the parties have arrived at settlement by parting their ways on certain terms and since it is a marital dispute, I deem it appropriate to accept the application and terminate the proceedings against respondent Nos.2 to 4, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed.
