Order 12/05/2026
1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.73/2026 registered at Police Sta- tion Sadar Deeg, District Deeg for offences under Sections 19 and 54 of Rajasthan Excise Act.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the petition- ers have falsely been implicated in this case. The allegations against the present petitioners is that the a large quantity of illicit
[2026:RJ-JP:19980] (2 of 2) [CRLMB-6544/2026] liquor as mentioned in the F.I.R. along with the amount of 37610/- was recovered from the conscious possession of the petitioners. The matter is exclusively triable by the Magistrate. The petitioners are behind the bars since 11.04.2026 without any criminal past. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in fur- ther custody, consequently the bail application deserves to be al- lowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material avail- able on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/ demerits of the case, I am inclined to grant benefit of bail to the petitioners.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Kanhaiya S/o Shri Banwari, Jagdish Prasad Sharma S/o Shri Ma- heshchand Sharma and Lokendrasingh S/o Shri Santosh, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all sub- sequent dates of hearing till conclusion of the trial.
