JUSTICE V SRISHANANDA ORAL ORDER After addressing the arguments for considerable length of time, a memo came to be filed by the counsel for the petitioner. Learned counsel for the respondent has endorsed no objection on the memo . 2. Contents of the memo reads as under “The Petitioner most respectfully submits that, the Petitioner was convicted for the offence punishable u/s 138 of N.I.Act and sentenced to pay a fine amount of Rs.5,75,000/-. Out of which, an amount of Rs.5,000/- is adjusted to the State and rest of Rs.5,70,000/-is awarded as compensation to the Respondent herein. The Petitioner submitted that, Rs.57,500/- was deposited on 02-01-2017 vide Demand Draft No.184509 dated 02-01-2017. Balance amount towards compensation is Rs.5,12,500/- is to be paid by the Petitioner to the Respondent and it is prayed that this Hon'ble Court be pleased to permit the Petitioner to pay the balance amount of Rs.5,12,500/-as per the following installments:- 1. Rs.1,00,000/- - on or before 31-03-2026 - 3 - HC-KAR NC: 2026:KHC:15710 CRL.RP No. 729 of 2018 2. Rs. 1,00,000/- - on or before 30-04-2026 3. Rs.1,00,000/- - on or before 31-05-2026 4. Rs.1,00,000/- - on or before 30-06-2026 5. Rs.1,12,500/- - on or before 31-07-2026” 3. Placing the memo on record, revision petition stands disposed of. 4. It is made clear that, if any of the instalments of the compensation amount as agreed in the memo is not paid, the order of the Trial Magistrate, confirmed by the First Appellate Court with regard to the imprisonment stand restored automatically. 5. Amount in deposit is ordered to be withdrawn by the complainant under due identification. 6. Office is directed to return the Trial Court records with copy of this order. 7. Fine amount of Rs.5,000/- imposed towards the defraying expenses of the State is hereby set aside as the case is privy to the parties and no State machinery is involved.
