IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondent No. 1 not to finalize the e-auction procedure pertaining to the property in serial no. 4 of the Annexure- I of the e-auction notification of Respondent no.1 vide Rc. ORDER :
The petitioner has participated is an unsuccessful bidder in the pursuance of E-auction notification dated 04.06.2026. It is the specific case of the petitioner that the last date for submission of bid along with EMD (Earnest Money Deposit) is 19.06.2026 by 05.00 PM. It is submitted that the petitioner has came to know that the some of the bidders were allowed to file their bids even after completion of the closing date and time. 2.
It is submitted that the petitioner submitted a representation sent by E-Mail bringing to the notice of the respondent authority that, certain bidders had allegedly remitted the EMD, registration fee/processing fee after the prescribed deadline, and that they were permitted to participate in the auction process and further sought verification of the time stamps and transaction records relating to EMD, registration fee and processing fee payments of all the participating bidders. 3. A further, E-Mail was sent on 01.07.2026 whereby, the petitioner brought to the notice of the respondent authority renewing her earlier request. It is submitted that the respondent No.1 had vide correspondent dated 04.07.2026, duly stated that the respondent No.1 had verified the records of all participating bidders and that no

participant was allowed to take part in the E-auction without complying the EMD payment timeline. It is also stated in the said correspondence that, none of the bidders were permitted to participate in the E-auction after the prescribed deadline. The petitioner had not placed on record of any proceedings to substantiate her apprehension. The writ petition is filed on mere apprehension. The E-mails addressed by the petitioner are also seeking clarification without any authenticated information. In absence of any material to substantiate the petitioners claim prima facie satisfying this court with regard to alleged irregularities in the E-auction conducted by the respondent No.1, no orders can be passed.
