5. Petitioner challenged a communication issued by Upper Mukhya Ahikari, Zila Panchayat, Udham Singh Nagar to Station House Officer, Police Station ITI, Kashipur, District Udham Singh Nagar. By the said communication, Station House Officer was requested to cooperate in stopping the petitioner from holding Haat Bazaar.
6. It is not in dispute that petitioner is not having any license from Zila Panchayat and the licence, which was issued to petitioner’s husband, was valid only till 2017. Even after expiry of term of the licence, petitioner is holding Haat Bazaar on a Bhumidhari land, which according to Zila Panchayat is impermissible, as only a person, who has been granted licence by Zila Panchayat for holding Haat Bazaar, is entitled for the purpose.

Learned counsel for the petitioner submits that petitioner filed WPMS No. 1606 of 2026, challenging the grant of licence in favour of respondent no. 7 and the said writ petition was disposed of with a direction to Upper Mukhya Adhikari to take decision on petitioner’s application dated 01.03.2026, within three weeks. Learned counsel for Zila Panchayat submits that Upper Mukhya Adhikari is yet to take decision on that application, as the period of three weeks is not expired.
8. This Court does not find any reason to interfere with the impugned notice. Without a valid licence, petitioner is not permitted to hold Haat Bazaar. As per byelaws framed by Zila Panchayat, no person can hold Haat Bazaar on his Bhumidhari land, without a valid licence granted by Zila Panchayat.
9. Thus, the communication issued by Upper Mukhya Adhikari to the Police Authorities cannot be faulted. Thus, there is no scope for interference with the impugned notice.
10. The writ petition fails and is dismissed.
