CORAM:
JUSTICE SASHIKANTA MISHRA ORDER_ 22.04.2026
1. This matter is taken up through hybrid mode.
2. Learned State Counsel has produced the record in Mutation Appeal Case No. 55 of 2019.
3. Perusal of the case record reveals that originally neither the vendors of the petitioner nor the petitioner was impleaded as a party. Subsequently, his vendors were impleaded as respondent Nos. 2 and 3, and notices were issued, but they refused to accept the notices. The petitioner was never impleaded, though it is submitted that he purchased the property during pendency of the appeal. Since the petitioner has purchased the property, prima facie, he has a right of hearing in the appeal concerning the land purchased by him. To such extent therefore, the impugned order cannot be sustained. The same is set aside and the appeal is remitted to the Sub-Collector, Jharsuguda for hearing afresh after directing impletion of the petitioner as a respondent and by granting him an opportunity of

4. It is made clear that this Court has not expressed any opinion on the merits of the case or the rival claims of the parties. The appeal shall be finally disposed of within four weeks from today. To avoid delay, the petitioner is directed to appear before the appellate authority along with copy of this order on 29th April, 2026 for fixing of further date of hearing.
5. The case record be handed over by the State Counsel for transmission of the same to the appellate authority.
