...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue a Writ of Mandamus or any other appropriate Writ, Order, or Direction, declaring the inaction of the Respondents, more particularly Respondent No. 3, in not initiating action to reconstruction the work files pertaining to the two agreements dated 27.03.2025, which are currently reported as missing/not traceable as illegal, arbitrary, and violative of Articles 14, 19(1)(g), and 300A of the Constitution of India Consequently, direct the Respondents more particularly Respondent No. 2 to consider the representation of the Petitioner dated 29.06.2026 forthwith and initiate immediate action to reconstruction of the work files pertaining to the two agreements dated 27.03.2025, which are currently reported missing/not traceable within a time-bound period stipulated by this Honble Court by directing the Respondents to process and release the pending payments for the completed works along with interest for the delay, within a stipulated time and to pass such IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the Respondents more particularly Respondent No. 2 to consider the representation of the Petitioner dated 29.06.2026 forthwith and initiate immediate action to reconstruction of the work files pertaining to the two agreements dated 27.03.2025, which are currently reported as missing/not traceable within a time-bound period stipulated by this Hon’ble Court by directing the Respondents to process and release the pending payments for the completed works along with interest for the delay, within a stipulated time pending disposal of the above writ petition and pass such Counsel for the Petitioner:

Order:-
The present writ petition is filed against the inaction on the part of respondent No.3 in not reconstructing the files relating to the works covered under two agreements dated 27.03.2025. It is the specific case of the petitioner that two works were entrusted to him by respondent No. 2 and that the petitioner successfully completed the said works. Thereafter, the petitioner approached the respondent authorities for preparation and finalisation of the bills. However, the relevant files pertaining to the said works were found to be unavailable. Consequently, the petitioner submitted a representation dated 29.06.2026 to respondent No. 2 seeking clearance of the bills and release of the amounts payable for the completed works. 2. The Deputy Executive Engineer of respondent No. 2, by endorsement dated 01.07.2026, informed the petitioner that the files relating to the subject works were not available and that the department had initiated the process of reconstructing the files after obtaining the necessary permissions from the competent authorities. It is further stated that the files would be reconstructed, to the extent possible, by verifying the available records, including the e- procurement data, agreement documents, estimates, measurements, and all other relevant records relating to the works. Thereafter, the concerned Assistant Engineer would record the measurements in the M-Book for finalisation of the bills payable to the petitioner. 4

The learned Standing Counsel appearing for respondents Nos. 2 to 5 submits that the authorities are already in the process of reconstructing the files and thereafter clearing the petitioner's bills. 4. Having heard the learned counsel for the petitioner and the learned Standing Counsel for respondents Nos. 2 to 5, this Court finds that the endorsement dated 01.07.2026 does not prescribe any time frame for completion of the reconstruction process. Accordingly, respondents Nos. 2 to 5 are directed to expedite the reconstruction of the files and complete the same within a period of eight (8) weeks from the date of receipt of a copy of this order. Thereafter, the respondents shall take consequential steps for finalisation of the bills and release of the amounts payable to the petitioner, in accordance with law. 5. With the above directions, the writ petition is disposed of. There shall be no order as to costs.. 6.
