We are of the opinion that the judgment and order impugned requires to be set aside as some of the issues would have still remained alive notwithstanding the fact that the period of lease had since come to an end and had not been extended. The appellant herein did have the right to contest the liability which may accrue during the subsistence of the lease period. 3. We, therefore, set aside the judgment and order impugned and restore the writ petition to its original number to be heard by the learned single Judge afresh. 2 HCJ & RRR, J WA_425_2026 4. The Writ Appeal is, accordingly, allowed. No order as to costs. Registry is directed to list WP.No.5639 of 2017 before the appropriate Bench having Roster.
