2. According to petitioner, he was awarded contract by State Public Works Department for certain civil work and petitioner completed the work to the satisfaction of the concerned authority; however, payment due to him has not been released.
3. Reliefs sought in the writ petition are as follow:
“i, Issue a writ, order or direction in the nature of mandamus to directing the respondent’s authorities to make the payment of Rs. 65,93,280.32 to the petitioner as he has completed his work.
“ii, Issue a writ, order or direction in the nature of mandamus to directing the respondent’s authorities to make the payment of Rs. 65,93,280.32 to the petitioner with interest 18% interest.”
4. Learned State Counsel was asked to get instruction. On instruction, he submits that due to paucity of funds, payment could not be released. He submits that if petitioner
2026:UHC:4850 makes representation to the District Magistrate concerned, decision shall be taken by District Magistrate, as per law, as early as possible.
5. The writ petition is accordingly,
disposed of by permitting petitioner to make representation to the District Magistrate concerned. If he makes representation within two weeks from today, decision thereupon shall be taken within six months thereafter.
